As of August 2015 there are twenty-two (22) states with legislation that affords “super-priority” to the liens available to community associations, making such liens superior to the liens of mortgage loans and other types of liens, to a varying extent. It’s important to note that the "super-priority" privilege varies by state and thus it’s important to know each states requirements.
Alabama, Alaska, Colorado, Connecticut, Delaware, District of Columbia, Florida, Illinois, Hawaii, Maryland, Massachusetts, Minnesota, Nevada, New Hampshire, New Jersey, Oregon, Pennsylvania, Rhode Island, Tennessee, Vermont, Washington and West Virginia.
